Saying it is legal for parents to buy guns for their children, the 9th U.S. Circuit Court of Appeals panel threw out a lower court's verdict finding the pair guilty of violating federal firearms laws. "Congress's purpose was only to prohibit those acquisitions of firearms by minors that are 'clandestine' or made 'without the knowledge and consent of their parents,' " the three-judge panel wrote in its 37- page ruling. In the case of Bobby Moore, who purchased a .25-caliber handgun with his mother's consent and the help of an adult friend, a lower court found his mother, Mary Peggy Moore, and the friend, Lee Roy Wiley, guilty of lying to a firearms vendor and conspiring to violate the federal laws. Moore's mother had told her son she thought it was OK for her son to buy the gun, but she refused to buy it for him because she did not want her name on the ownership papers. So, her son approached Wiley, a neighbor, and asked him to buy the gun for him. Wiley agreed. The threesome went to the gun shop in September 1993. The clerk at the shop verified that Moore's mother consented to the sale and sold the gun to Wiley. In turn, Wiley gave the gun to Moore's mother, who subsequently gave it to her son. After Moore was convicted of killing an Idaho police officer in January 1994 with the gun, a public outcry erupted calling for the prosecution of the adults who helped him get the firearm, the ruling said. "While the shooting death of the police officer was tragic, and Moore may have exercised extremely poor parental judgment in permitting her son to have the handgun, neither we nor the Bureau of Alcohol, Tobacco and Firearms can criminalize what Congress did not," the court found in a 2-to-1 ruling, explaining that Moore did nothing wrong giving her son the OK to buy the gun. However in a dissenting opinion, Judge Stephen S. Trott said he thought the majority opinion overlooked a key fact: the teen's mother did not actually buy the gun -- a friend bought it. "Once she said 'no,' refused to put her name on the papers, and told him (her son) he would have to find 'a different way' involving 'someone else' to get a gun... Mrs. Moore's authority to arm her son ended, as did her son's lawful ability to obtain the coveted handgun," Trott wrote. Wiley had no authority to buy the gun for the younger Moore -- despite his mother's consent -- because Wiley was not the teen's parent or guardian, rott wrote. Wiley also lied to the dealer, saying he was Moore's grandfather when in fact he was not, further bolstering Trott's opinion in favor of upholding the convictions.
