What -> rights do I have under the law? You have the right to call a new IEP any time you want, and you do NOT have to agree with the school's findings. If there is a disagreement about whether or not he is SED, the school will have to pay to have an outside party evaluate your son. They may or may not agree with what the school has found. If another evaluator feels your son's difficulties are related to ADHD, but he does not require special education, the school should write up a 504 plan that will accomodate his special needs so that he gets the same education as the rest of the students. Another option, if you have the time, is to spend a lot of time volunteering in your son's classroom. That way, he will know he needs to be on his best behavior and you will be able to show his teacher the strategies you have found effective for teaching him and getting him to work. I'm not saying this is true of your son, but some kids who struggle and have a lot of difficulty with school, have found that they can get out of their work by acting as if they don't know how to do it or acting out in class. How did you come to realize there was a problem in the first place, how did you identify it as ADHD, and do you have any advice for someone on active duty who seems to match a LOT of the symptoms described in this forum but has no interest in premature discharge? I know I can just ignore it and continue the way I have been for 32 years, but the thought of correcting the problem instead of adapting to it is very enticing. BTW have you tried filing a complaint with your State Board of Education against the school for failure to test? There are some Federal laws you can invoke to put pressure on the school as well but I don't remember what they are at the moment maybe somebody else on the echo will know them. I would also consider filing a complaint with the SBofE against the school for emotional abuse and failure to educate which BTW a few attorney's may take the case on a percentage basis and sue the school in court also. If she is exhibiting these signs that you listed what is your family doctor doing about it?
