This bill would require the hearsay declarants to be present in the court for examination by defense counsel. SB 402 Secures to parents the right to trial by jury in juvenile court dependency proceedings. Senator Maurice Johannessen: SB41 Will reduce the absolute civil immunity of social workers to that of police officers. Assemblyman David Knowles: ACA 17 An Assembly Constitutional Amendment that provides that parents shall also enjoy the right to a jury trial in juvenile court dependency cases under Article I, Section 16 of the Constitution of the State of California. AB 1347 Requires the placement of children with relatives when they are taken from parents. AB 1348 Provides that parents shall not be required to pay court costs or foster care costs when the case has been dismissed by the juvenile court as unfounded. AB1349 Makes it a felony to make an intentionally or criminally negligent false report of child abuse to any CPS or mandated reporter. Penalties are 2, 3, or 4 years in prison and a $15,000 fine. AB1350 Another relative placement bill similar to AB1347. AB 1351 Provides that the Child Abuse registry at DOJ shall not contain any reports that are not founded. AB 1353 Establishes the statutory right to a jury trial in juvenile court dependence proceedings. AB 1354 Lowers the absolute civil immunity of social workers. We are getting ready for a couple more court battles ourselves, first the one with the boys on the 16th of this month (falsely accused of molesting/raping their sister) and then it looks like we may be filing a "Change in Circumstance" petition at the end of the month, so that we can once again try to get our daughter home before June. If we can't get her home, at least we may be able to eliminate the "supervised" visits and phone calls and have normal visits and phone calls instead. Even that would be a drastic improvement. Luckily our counseling center is going to urge the courts to return our daughter as they feel that emotional damage is being done to her by her forced stay in foster care, and the counselors feel that she has a very loving and supportive home (ours) and that that's where she should be! I am working to try to help get enough support to pass a new bill here in California (you probably already read about it on one of my earlier posts) but it is a tort liability for social workers, that would give them "limited immunity" for their actions rather than "total immunity". :) :) :) It would be great to see that happen. We may not benefit directly, but it would help keep other families from going through the grief we're going through, and that would be worth it to me! Anyone that has doubts about how much influence the government has in emoving our parental rights should read "The Child Abuse Industry". I thought some of it was a little bit on the fanatical side - especially when it talked about classes that the kids would have on learning values (that may be opposed to the values the parents want them to have) - BUT I asked my kids about it and my kids have participated in those classes WITHOUT my knowledge and consent! That really irks me! Now more and more schools are going with uniforms and it's starting to remind me of what happened in Russia. I have friends with little kids (pre-school) and people from various agencies keep pestering my friends about putting the kids into pre-school, and they WON'T let up! Why do little tiny kids need to go to school? This is getting frightening. It's not just the laws in North Carolina that are wrong, it's all over, and not just in America either. Canada is having a horrible problem with the Children's Aide Society. There are many countries experiencing these difficulties as well. It does need to change, and we need to work together to make it happen. I too will keep up the fight for as long as it takes, and so will my husband. Some of my children have volunteered to do what they can to help as well. It has gotten to the point where they are afraid to grow up and have children of their own, and they shouldn't have to feel that way. Anyway, I'd better go. The obituary on the death of the concepts embodied in House Bill 1966 "was premature," said Rep. Russ Roach, D-Tulsa. "It took me four years to pass tax-increment financing. I don't intend to give up until the rights of Indian parents are written into state law." Roach said he introduced the bill because, "Indian tribes treat their own members in a paternalistic manner," asserting that the tribes think they "can make better decisions" about the voluntary placement of children than the parents themselves can. "After years of complaining that the federal government treats Indians in a paternalistic fashion, I find that ironic," Roach said. There were general provisions of HB 1966 which benefitted Indians. These were: Indian tribes would be prohibited from interfering in child-custody matters stemming from divorce proceedings. "We don't even allow the State of Oklahoma to interfere unless there is compelling evidence a parent has done something wrong," Roach said. "Interference from Indian lawyers is just as bad as interference from state-government bureaucrats." An Indian child placed in a non-Indian home would have to be informed of his/her tribal affiliation when they turn 18 years old. Indian tribes would have been permitted to access federal funds when resolving difficult placement cases, such as those involving handicapped children. During his tenure in the Legislature, "I have learned that right doesn't always prevail on the House or Senate floor," the fifth-term lawmaker said. "False information has won many a legislative debate." Even though HB 1966 was defeated in the House by a vote of 10-90, "I intend to proceed in behalf of Indian children, who also are entitled to the state's protection," Roach vowed. "Even Indian attorneys told me there was nothing wrong with my bill," he said. Many then told members to vote against the bill without informing Roach. Good News! Today, two of my sons (Travis and Daryl) were supposed to have a trial. They were victims of false accusations, and today, we had some relief. Here is what happened.... For some unknown reason (at least unknown to me), the DA dropped all of the charges against Travis, and reduced the felony charge to a minor misdemeanor on Daryl. (YEAH!) In exchange for this, the boys were both placed on informal probation" for 6 months. Daryl pled "no contest in his best interest" (I on't remember what the charge was since it happened so fast and so unexpectedly. I think it was attempted battery or something like that.) Anyway, when the 6 months is up, the charges against Daryl will be dismissed and then it will be erased from his record! No, it is not a complete victory, but it is a MAJOR victory. Travis had been falsely accused of molesting our 9 year old daughter. Daryl had been falsely accused of raping our 9 year old daughter. Our daughter and Daryl did engage in some inappropriate looking and touching (almost a year ago - they were both clothed and there was NO penetration) but that was the extent of it. If the DA had prosecuted them and IF he had won, both of the boys could have been placed in the California Youth Authority for up to 8 years! As I understand it, this particular DA does NOT make deals and he does NOT back down - but he did today, and for that I am grateful. I don't like the idea of the boys being on "informal probation" for 6 months, but I am so happy that it did not go the other way. This is something that we can live with since it is temporary, and will not be on their records. It also reinforces what we have been telling CPS (Children's Protective Services) all along. Now that this is over and done with, perhaps CPS will finally let our aughter come home. She has been in a foster home since November 28, 1994, a total of 108 days. I know it will be a little longer, but I am confident that today as a major hurdle that we needed to cross over before we could get her home, and now that it is done, there is NOTHING to stop us from getting her back! Thank you for all the support you have given me over the past couple of months. It has been greatly appreciated. (I know, we still have a little ways to go, but we'll get there.)
